Separate the alleged action from the claimed effect
Start with the charge papers or the police request and identify the property involved. Explain what you are alleged to have done and what damage, interruption or loss of use is said to have followed. Mischief can concern interference with lawful use or enjoyment even when nothing is broken. Tell counsel whether you dispute the act itself, its effect, responsibility for particular damage or the circumstances in which it occurred. If you do not yet know the allegation in full, identify that gap rather than trying to reconstruct it from a repair bill or a conversation with someone else.
Discuss your account and the surrounding circumstances privately with counsel
Discuss the event privately with defence counsel, including what you understood about access, permission and the property’s condition at the time. Ask whether and how to prepare separate notes. If you describe an accident, explain the sequence and what supports that account. If an act was intentional but you dispute the effect alleged, explain that distinction accurately. A disagreement about an arrangement and a criminal allegation require separate assessment. Keep relevant instructions, permission messages and ownership or occupancy papers available. Paying for an item or sharing ownership does not automatically settle another person’s rights or answer a mischief allegation.
Identify the evidence for each disputed consequence
Where the allegation concerns several damaged items or more than one period of interruption, identify them separately. Note which photograph, message, witness account or other record relates to each point, and what you can personally confirm. An image may document a condition without showing when it arose or who caused it. Explain any known earlier defect or later change using records you lawfully hold, and mark matters you cannot verify. Preserve the originals and full exchanges; ask counsel whether and how to prepare any separate explanation instead of annotating or altering the source record.
Review a repair request before deciding how to respond
Keep the complete quote, invoice or payment request and any covering correspondence. Identify the work proposed, what has already been done and which part you are being asked to accept or pay. Tell counsel about any earlier payment, repair or promise so advice can address the whole situation. A quoted cost does not establish who caused the damage, and repair or payment does not automatically end a prosecution. A request to resolve the property issue should be considered alongside the criminal allegation and current conditions before you contact someone, agree on work or attend the property.
Raise access problems and upcoming obligations at the start
Use the latest undertaking, release order and later directions to identify a contact or location restriction and any written exception. Explain the practical problem, such as access to belongings or a workplace, without returning to a prohibited place to collect evidence or arrange repairs. A private invitation does not change a binding condition. Keep the next court and fingerprint instructions available and use the actual papers to confirm attendance. A Mississauga address does not assign the court; waiting for a quote, disclosure or a consultation does not excuse a required appearance.

- Identify the alleged action and each claimed damage or interruption, marking what you dispute and what is still unknown.
- Keep lawful records of permission, property condition and the event, with your account separate from the originals.
- Preserve the entire repair or payment request and explain anything already agreed, completed or paid.
- List current access or contact restrictions and the next required appearance before arranging practical steps.
Keep the initial website enquiry brief. Do not upload or send sensitive documents through the form; arrange any document review directly with the firm.

Common questions
Can the allegation concern loss of use rather than broken property?
Yes. Mischief can include interference with lawful use or enjoyment. Identify the alleged conduct, what someone was said to be prevented from doing and the relevant records so counsel can assess the specific form alleged.
What if I agree that I handled the property but dispute causing the damage?
Explain that distinction and the sequence of events privately to a criminal lawyer. Keep any lawful records of the earlier condition, your actions and later changes. Acknowledging one fact does not answer every issue; the allegation, responsibility and required legal elements still need assessment.
Does a repair invoice establish responsibility for everything listed?
No. An invoice may record work or cost, but it does not by itself establish who caused each item of damage or the circumstances. Preserve the whole document and identify the specific entries or assumptions you need reviewed.
Can I return to the property to photograph it or carry out repairs?
Do not do so if it would breach a current restriction. Provide the actual terms and any written exception, and discuss a lawful way to address the evidence or repair question. Another person’s invitation does not itself change a binding condition.
Will agreeing to pay end the charge or cancel my next appearance?
Not automatically. A repair or payment arrangement does not itself end the criminal prosecution or remove a court obligation. Discuss the complete proposal with counsel and continue to follow the current conditions and attendance instructions.
