Punjabi consultations and court interpretation

For an Ontario Court of Justice criminal appearance, contact the courthouse before your court date to request an interpreter, or tell the judge or justice of the peace at the appearance. That court provides interpreters without charge. Confirm arrangements separately from your Punjabi consultation. Documents or evidence in another language may require a separate translation; confirm what is needed before paying for one.

Identify the threatened act and the particular allegation

Section 264.1 concerns specified threats involving death or bodily harm, property damage, or harm to an animal or bird belonging to someone. An insult or unpleasant statement is not automatically a threat within those categories. Keep the exact count and alleged words available. Counsel needs to know which category is alleged, how the words were communicated and what is disputed before assessing the evidence or consequences.

Preserve the original Punjabi voice note or exchange

For a voice note, keep the complete audio rather than an edited clip. For text, retain the full conversation, including surrounding messages, account details and dates you lawfully hold. If the message uses Punjabi written in Roman letters, identify how you read it without replacing the text with a corrected version. Mark pauses, unclear words or disputed speakers for counsel. Keep any English summary separately, noting who prepared it and what original material they used. Do not delete the conversation or seek access to another person’s account to complete your file.

Explain context and intended meaning as separate questions

For a death-or-bodily-harm allegation, whether the words were meant to intimidate or be taken seriously needs assessment; that is not the same as intending to carry them out. A screen name or translated extract should be reviewed in its context rather than treated as the complete account.

Do not use a clarification or apology to breach conditions

Keep every current undertaking, release order and later variation together. Read any direct-contact, indirect-contact or address restriction and written exception before acting. An incoming message, apology request or private invitation does not alter a binding term. Sending Punjabi words through a relative is still communication that may be prohibited. Raise any work, property or family problem with counsel while following the existing conditions until lawfully changed.

Discuss evidence, procedure and possible consequences

State whether police are requesting an account, charges have been laid or disclosure has arrived. Keep the next court and fingerprint directions separate from a consultation appointment. Can I request advice before police give me all the evidence?
