Match each allegation to the papers and item it concerns
Keep the complete charge papers, release documents and any seizure or property record you received. Note the alleged date and identify which item or conduct each count appears to concern. A possession allegation, a storage allegation and an allegation involving use raise different questions, even when they arise from one police investigation. If a document uses a classification or description you do not understand, flag it for counsel rather than assuming a familiar name identifies the legal category. Where police have contacted you before charges are laid, explain what they have requested and what information is available.
Discuss access and control privately with counsel
Explain where the item was reportedly found, your connection to that place and what you knew at the relevant time. In a shared home, workplace or vehicle, identify who could access the location and the records that may help explain the arrangements. Separate your own observations from assumptions or information received later. Ownership alone does not answer every possession question, and a shared location does not automatically provide a defence. Counsel can compare your account with the allegation and available evidence before advising on the issues that matter.
Keep authorizations and restrictions in their date order
Have existing licences, registration or authorization records, notices and relevant correspondence available, including documents that were replaced or changed. Tell counsel which papers relate to the alleged date and which describe the current position. A licence is relevant evidence, but it does not answer every possession, storage or handling allegation. The item, exact provision and law applicable to the alleged conduct need checking. Also identify any prohibition, undertaking or release order and any written exception. Do not assume that an older authorization or another person’s permission overrides a current restriction.
Identify the available records without handling or moving an item
Preserve original lawful photographs, messages, receipts and location records already in your possession. Keep the police description or inventory alongside your own notes about disputed or missing details. If a photograph or report leaves something unclear, identify the question rather than trying to recreate the scene. Do not bring a firearm or ammunition to the office, handle an item for a demonstration or breach a condition to retrieve it. Ask counsel how any evidence or property issue should be addressed lawfully. A consultation can review the allegation without you personally moving or transferring an item to make it available.
Bring the next court obligation into the discussion
Keep the next court and fingerprint instructions with the current conditions, and distinguish an upcoming appearance from a date for an office consultation. Common questions
Does having a firearm licence answer the charge?
Not necessarily. The relevant item, exact allegation, dates and authorization requirements must be assessed. A licence does not answer every storage, transport, handling or possession allegation. Keep the documents and any current restrictions available for review.
Is ownership the only issue if an item was found in a shared place?
No. Ownership, knowledge, access and control may raise different questions in the particular case. Explain the arrangements and identify supporting records without assuming that shared access either proves the allegation or automatically defeats it.
Should I bring a firearm or ammunition to the consultation?
No. Start with the papers, a description and the lawful records you already have. Do not handle or move an item for a demonstration or breach a restriction to retrieve it. Raise any property or evidence question with counsel so an appropriate lawful step can be considered.
Can I seek advice before receiving all of the disclosure?
