Different assault allegations

The wording on your charging document matters. The Crown must prove the offence beyond a reasonable doubt; the same incident may raise injury, weapon and relationship issues that need to be considered separately.

Assault Causing Bodily Harm: connecting the injury to the allegation

When seeking an assault lawyer serving Mississauga, bring the charge document rather than relying only on the description given at arrest. Under section 267(b), the Crown must prove an assault caused harm affecting health or comfort beyond a merely transient or trifling hurt, together with the required fault. Unlike ordinary assault, this allegation requires proof of that qualifying harm.

Counsel can compare treatment records with the timing of photographs and witness statements. If a recording may exist at a workplace, shop or residential building, identify it promptly so preservation can be considered. Do not edit original files or approach a witness to agree on an account. A conviction can involve imprisonment; the indictable maximum is 10 years, not an expected sentence.

Aggravated Assault: the specific result matters

Aggravated assault requires proof that an assault wounded, maimed, disfigured or endangered someone’s life, with the necessary causation and fault. A hospital visit alone does not settle those questions. The fault requirement includes objectively foreseeable bodily harm; the Crown need not prove an intention to cause the exact serious result.

Domestic Assault and returning to a shared home

Domestic assault is a relationship description, not its own Criminal Code offence. The charge may be ordinary assault, bodily-harm assault or aggravated assault, and the Crown must prove that underlying offence. The relationship does not replace the need for evidence.

If release terms prevent you from returning to a shared home, a partner’s permission is not enough to override them. Counsel can discuss a lawful variation and arrangements for belongings or children. Preserve complete communications and disclose any family orders. Penalties depend on the underlying charge, with intimate-partner abuse an aggravating sentencing factor; a complainant’s request does not automatically stop the prosecution.
