Punjabi consultations and court interpretation
Dildeep Sahi provides consultations in Punjabi, English and Hindi. Tell the firm which language you prefer when arranging the appointment. Speaking Punjabi with your lawyer does not make Punjabi the language of the court proceeding or book a court interpreter.
For an Ontario Court of Justice criminal appearance, contact the courthouse before your court date to request an interpreter, or tell the judge or justice of the peace at the appearance. That court provides interpreters without charge. Confirm arrangements separately from your Punjabi consultation. Documents or evidence in another language may require a separate translation; confirm what is needed before paying for one.
Understand what the theft charge alleges
Theft is more than an item being missing from a receipt. Section 322 addresses fraudulent taking or conversion without colour of right and a specified intent, which can include temporary deprivation. The payment sequence, permission and intention need assessment. Describe the items, what you intended to purchase, any payment attempt and what happened next. A mistake explanation or receipt is a point for review, not an automatic answer to the charge. Use the actual count in your papers; a store’s description and a criminal charge are different records.
Explain the checkout exchange in Punjabi
Tell counsel what you saw on the screen, what an employee asked, what you said and whether you understood the response. Separate your own recollection from a companion’s account. Keep any original messages about the purchase and the receipt or payment confirmation that followed. If Punjabi was used during the event or in later exchanges, identify the speaker and surrounding conversation. The purpose is to understand the sequence accurately, not to assume a language difficulty establishes a defence. Punjabi consultations are separate from any interpretation needed for a court appearance.
Preserve the payment and recording trail
Keep original receipts, bank transaction entries you lawfully hold, refunds and store correspondence together, identifying the item or attempted payment each concerns. Note the approximate checkout time, location and any recording you believe may exist so counsel can consider preservation steps. Do not edit a receipt, delete messages or return to a restricted store to obtain footage. A bank entry may require explanation alongside the checkout record; it should not be treated as proof of every disputed detail. Arrange detailed evidence delivery directly rather than uploading financial material in the enquiry.
Separate value, payment demands and court obligations
The value alleged matters to the theft penalty framework: section 334 provides different categories above and at or below $5,000. Possible imprisonment is a consequence, not a prediction of your sentence. Preserve any civil demand, payment proposal or return record separately. Paying a store’s demand or returning goods does not itself cancel a criminal appearance. Before approaching the store or another person, raise any current no-contact or location condition with counsel. Keep following the actual terms unless they are lawfully changed.
Turn the allegation into questions for a defence review
Have the charge papers, current conditions and any disclosure available. Identify the disputed step: the selection of an item, scanning, payment, identification or an exchange with staff. Counsel can review the prosecution material against your records, identify missing information and discuss the available response. Tell the firm about every required court or identification date. An initial consultation does not reserve attendance or excuse a direction while the evidence is being assessed.

Common questions
Does an honest checkout mistake automatically end the case?

Can I use Punjabi to explain a conversation with store staff?

Will paying the store guarantee that the charge disappears?
No. A civil demand and the criminal proceeding are separate. Keep any proposal and payment record, continue to follow current directions and obtain advice before responding or making contact.
What if a condition prevents me going back to the store for my receipt?
Do not enter contrary to the condition. Keep what you lawfully have and tell counsel which record is missing. An invitation from staff does not itself change the restriction.
