Punjabi consultations and court interpretation

Dildeep Sahi provides consultations in Punjabi, English and Hindi. Tell the firm which language you prefer when arranging the appointment. Speaking Punjabi with your lawyer does not make Punjabi the language of the court proceeding or book a court interpreter.

For an Ontario Court of Justice criminal appearance, contact the courthouse before your court date to request an interpreter, or tell the judge or justice of the peace at the appearance. That court provides interpreters without charge. Confirm arrangements separately from your Punjabi consultation. Documents or evidence in another language may require a separate translation; confirm what is needed before paying for one.

The domestic context and the actual offence are different

Domestic assault describes an allegation in a relationship or family context; it is not a separate Criminal Code offence with one fixed set of elements. The written count may allege assault, assault with a weapon, assault causing bodily harm or another offence. Ordinary assault can include intentional force without consent even without a visible injury. Begin with the charge wording and alleged conduct so the legal discussion does not depend on a broad label.

Read home and contact restrictions before making plans

Check the current undertaking or release order for named people, addresses, direct or indirect communication restrictions and any written exceptions. Being invited home or agreeing privately to reconcile does not remove a binding condition. If clothing, medication or work items remain at a restricted address, identify what you need and seek advice about an appropriate lawful arrangement. Do not send a relative to carry a message or negotiate contact that the terms prohibit.

Raise parenting needs alongside every existing order

If children are involved, bring the criminal terms together with any parenting order or written agreement. An arrangement allowing parenting time should not be assumed to override a criminal no-contact or location restriction. Explain any urgent exchange, school or care issue in Punjabi, including which communication would be needed. Counsel can assess the documents and the proper step without treating a necessary family task as permission to ignore an order.

Do not ask a partner to make the case disappear

The complainant does not control whether the Crown continues a prosecution. Ontario’s intimate-partner-violence prosecution directive says charges must not be withdrawn solely because the complainant requests it; the circumstances and evidence still matter. Do not pressure a person to retract an account or approach them contrary to a condition. Give your lawyer any information already lawfully received so it can be considered through the proper channels.

Explain the relationship evidence without rewriting it

Preserve complete messages, voice notes and relevant records rather than only excerpts that support your account. Identify who spoke Punjabi, who translated a passage and where a police summary differs from your understanding. Separate what happened during the alleged incident from earlier relationship disagreements. If retained, counsel can compare that account with disclosure, request relevant missing material and assess the specific allegation and any available defence.

Understand decisions and consequences privately

You can ask for a private Punjabi discussion before giving instructions about a plea, trial or proposed conditions. Another family member’s wish to reunite or finish the case does not replace your informed instructions. The actual offence and facts affect possible punishment; proven abuse of an intimate partner or family member is an aggravating sentencing factor. That principle does not establish guilt from an allegation or predict the sentence in your case.

Arrange the consultation without assuming court interpretation

Can the complainant withdraw a domestic-assault charge?

The Crown decides whether to continue the prosecution. A complainant’s request alone does not require withdrawal under Ontario’s prosecution directive. The available evidence and circumstances must still be assessed.

Does a parenting order let me contact the other parent despite a criminal condition?

Do not assume so. The two documents must be reviewed together, including any specific exception. Ask how the parenting arrangement can proceed lawfully while existing criminal terms remain in effect.

Can I have the consultation without relatives present?

Yes, tell the firm you want to discuss the matter privately. The lawyer needs your own instructions. A relative helping book an appointment does not automatically become part of the legal discussion or a court interpreter.
