Identify the request, charge or decision in front of you

Bring the actual police communication, charge papers or written proposal that prompted the enquiry. Explain who sent it, what response has been requested and any known date. Keep a demand for repayment or a civil document separate from criminal papers so counsel can identify the issues needing assessment. Say whether you have already given a statement, supplied records or retained another lawyer. Before giving a voluntary account to police, obtain advice about your position and any specific obligation to respond.

Show what authority you had and what you actually did

A transaction may involve someone requesting a payment, someone approving it and someone processing it. Identify your part without treating a job title, account name or signature as the complete explanation. Keep any relevant authorization, approval message, contract, instruction or access record you can lawfully obtain. Distinguish general access to an account from the records of a particular disputed step. Mark what you know personally and what you learned later. These details help counsel examine the allegation rather than infer a person’s role from a single document.

Connect the disputed steps to the original records

Prepare a short list of the transactions or representations being questioned. For each, identify the date, the record that documents it and the explanation or context you want reviewed. Keep complete messages, agreements, invoices and statements as they were received. Separate missing records from those you hold, and identify who may have the missing material so counsel can consider lawful ways to obtain it. Common questions

Does this page cover recovering money from someone I believe defrauded me?

This page explains criminal lawyer services for an investigated or accused person. A civil recovery claim is a separate task. What if another person approved the transaction?

Preserve the approval and the complete surrounding communications. Explain who gave the instruction, what you understood it to cover and what you did. An approval may be important evidence, but its effect on the allegation needs assessment; do not assume it automatically ends the case.

Can I obtain missing records through another person’s account?

Do not use someone else’s login or access records without lawful authority. Identify the material and who may hold it so counsel can discuss an appropriate way to obtain it. Preserve the original records you already lawfully have without altering them.

Will offering repayment automatically end a fraud charge?
