Punjabi consultations and court interpretation

Match every count to the allegation it contains

An assault-with-a-weapon allegation under section 267(a) concerns an assault involving carrying, using or threatening to use a weapon or imitation. A standalone possession charge or a firearm allegation has different elements and should not be treated as interchangeable. Keep each count and its wording available. If police identify different objects, people or moments, separate them in your account before discussing what evidence supports or contradicts each allegation.

Examine who could identify the person and object

Where several people were present, identify who was said to be holding the item and what each witness could actually see. Distance, timing and the start or end of a recording may be questions for evidence review, not assumed reasons the charge fails. Preserve any lawful original video or photographs without enlarging, annotating or replacing the source file. Record your explanation separately so counsel can distinguish the record from your interpretation of it.

Account for an imitation and the surrounding words

The weapon provision expressly includes an imitation, so saying an item was not real does not by itself answer the charge. Identify what it looked like, what witnesses were told and the conduct police allege. If Punjabi words were described in English as a threat, retain the original words and any available recording. Counsel can assess the meaning in context alongside the assault allegation; an informal translation or isolated phrase should not replace the full conversation.

Separate contact, threatened use and any injury evidence

Some allegations concern a physical strike, while others concern a weapon carried or threatened during an assault. If your position is that you acted protectively, describe the perceived force or threat and your response; self-defence depends on its legal requirements and the circumstances, not merely who started an argument.

Keep practical arrangements from becoming a new breach issue

Read current contact, location and weapon conditions together with any later changes. If an item remains at a shared property or you need equipment for work, identify the need without collecting it contrary to the terms. Do not use a family member to send a message or obtain an account prohibited by a condition. Counsel can assess an appropriate lawful step while the existing terms continue. A private agreement does not amend them.

Review the procedure and proposed outcome in Punjabi

A section 267 charge can proceed by indictment or summary conviction; on indictment, the maximum imprisonment is ten years. The procedure, offence and personal circumstances require individual assessment, and the maximum does not predict a sentence. If retained, counsel can examine disclosure and discuss resolution or trial options in a way you understand. Ask what a proposal would admit and require before deciding; no particular outcome follows automatically from an imitation item or conflicting accounts.

No automatic conclusion follows from carrying an item. Section 267(a) applies in committing an assault, and whether the item qualifies as a weapon or imitation and the alleged conduct can be proved must also be assessed.

Can assault and a possession allegation appear in the same paperwork?

Yes, different counts can be alleged from an incident. They have their own elements. Keep all the charge pages together so counsel can assess the connected allegations rather than treating one count as the whole case.

Should I ask witnesses to agree on an English version before calling?

No. Preserve existing original-language records and identify potential witnesses for counsel without coaching accounts. Follow every contact restriction. The lawyer can assess whether any translation or other evidentiary step is needed.
