Identify the next required step before asking who will handle it

Have the latest court notice, release papers and any later directions available. Note the next date, the type of event and what you understand must happen before then. If you do not know whether a document asks for attendance, information or another response, make that the question for advice. Identify the court level and location written on the papers; living in Brampton does not settle the venue or attendance method. An application to LAO or an enquiry to the firm does not extend a deadline or excuse a required appearance.

Separate earlier help from an agreement to keep acting

Tell the firm who has assisted so far and what that assistance involved. Duty counsel’s help on a court date is different from retaining a lawyer to take the case under a certificate. If another lawyer is involved, make two short lists: the work you understand has been agreed, and the work you still need someone to accept. Identify separately who will deal with disclosure, give advice about the next decision and attend or speak at court. Keep any written confirmation available and mark uncertain arrangements as unconfirmed. Do not assume that a new enquiry ends an existing retainer, transfers a certificate or arranges another lawyer’s attendance. Those questions need to be addressed expressly.

Describe the work still needed alongside the certificate wording

List the particular help you want considered, such as advice about disclosure, preparation for a bail hearing or attendance at the next court event. Have the complete certificate or LAO decision available, including what charges or work it identifies. Mark any uncertainty between that wording and the work you are asking for. LAO decides eligibility and coverage; the firm separately decides whether it can accept the matter. A certificate does not automatically cover every charge or step, and it does not by itself confirm that this firm will undertake the work.

Show what has already happened without sending the whole file first

Start with the last court date and make a short list of what has happened since: documents received, steps taken and instructions still outstanding. If more than one criminal file is involved, keep each file number, next date and certificate information separately identified. Note any disclosure still awaited and any question another lawyer or duty counsel asked you to follow up on. Keep the original documents together and separate your recollection from what is recorded. This helps the firm understand the proposed starting point without assuming earlier work must be repeated or has resolved the next task. Keep the initial website enquiry brief; arrange any detailed certificate, disclosure or other sensitive-record review directly with the firm.

Raise a new charge or changed court event promptly

If another charge is laid, a bail issue arises or the next event changes, identify exactly what is new and when you learned of it. Keep the new papers with the earlier documents. Ask LAO about any uncertainty in the authorized work and tell the lawyer currently involved what has changed. Do not assume that coverage or representation has expanded automatically. Confirm the requested work with the Mississauga office

You do not need every item before getting in touch. Mention any approaching court or response date.

Common questions

Duty counsel helped me at my last appearance. Does that mean they will take my whole case?

Do not assume so. Duty counsel assistance and an ongoing certificate retainer are different arrangements. Explain what help you received and what remains to be done. Confirm the arrangements for the next step rather than relying only on the fact that someone spoke with you previously.

LAO has issued a certificate. Can I tell the court that Aftermath Law represents me?

Only after the firm has actually agreed to act for the relevant work. A certificate does not retain this firm or confirm attendance. The matter, certificate, conflicts and availability must be checked, and the scope of representation must be agreed.

Can I request a consultation if another lawyer is already involved?

You can ask the firm to consider your situation. Identify the existing lawyer and what advice or work you are seeking. Do not treat that enquiry as ending the current arrangement, transferring the certificate or confirming replacement counsel. The next steps and any limits must be discussed expressly.

What should I do if the court date changes while I am waiting for LAO?

Keep the updated directions and tell LAO and any lawyer currently involved about the change. Follow the current court requirements. If you do not have a lawyer, the Ontario criminal Legal Aid guide links LAO’s approaching-court-date assistance; waiting for a funding decision does not itself postpone the case.

Does the free consultation include taking over the file or attending the next date?

No. The initial discussion covers your situation, options and possible representation. A file review, legal opinion, urgent action or appearance must be separately agreed. State the next known date so the firm can consider the request, but do not assume availability or acceptance.
