Punjabi consultations and court interpretation

For an Ontario Court of Justice criminal appearance, contact the courthouse before your court date to request an interpreter, or tell the judge or justice of the peace at the appearance. That court provides interpreters without charge. Confirm arrangements separately from your Punjabi consultation. Documents or evidence in another language may require a separate translation; confirm what is needed before paying for one.

Give each alleged event its own place in the timeline

Use the actual charge papers or police request to identify the date range and conduct in question. A broad statement that there was a family or workplace disagreement can leave the relevant event unclear. For each visit, call or message, note the date if known, people involved and source of your information. Mark uncertain dates instead of filling gaps. Counsel must assess the conduct category, mental element and safety question under the law applicable to those events; not every category depends on repeated communications.

Separate shared places from alleged following or watching

If the allegation involves a workplace, residence or another place you both used, explain the ordinary arrangement and the particular attendance questioned. Identify why you say you were there and any records already lawfully available, such as a work schedule or your own messages. Keep your explanation distinct from what a witness is said to have observed. Do not return to obtain evidence if conditions prohibit attendance. Counsel needs the actual sequence, not an assumption that a shared location either proves harassment or automatically rules it out.

Trace communications relayed in Punjabi or through relatives

A person may arrange an appointment or explain a message without having witnessed the underlying event. Identify who sent the original words, who received them and who later translated or relayed the account. Keep any Punjabi voice notes, written messages or transliterated text unchanged. Explain which meaning you understood and which wording you are unsure about; label your recollection separately from another person’s summary. Do not ask relatives to coordinate accounts or carry a fresh explanation to the complainant. Further records or formal translation can be considered as part of an agreed evidence review.

Address the safety issue without relying on a label

Annoyance and a safety allegation should not be treated as interchangeable descriptions. Identify what the records show and what you actually knew at each stage. Section 264 changed in 2026; counsel must check the alleged dates before deciding which safety test applies. The current provision addresses specified conduct that, in all the circumstances, could reasonably be expected to make the other person believe their safety, or the safety of someone known to them, is threatened. Safety includes psychological safety. A later friendly message or an assertion that nobody was frightened does not decide all of those questions. Bring the full context rather than assuming one response resolves the case.

Keep family arrangements and criminal conditions distinct

If the same people are involved in parenting, property or another family issue, gather the relevant orders separately from the criminal release terms. Do not assume a practical arrangement or permission from the other person changes a no-contact or location restriction. An apology delivered through a friend can still be prohibited indirect contact. Identify the specific communication or access problem for counsel while continuing to comply. Any lawful change needs to be confirmed before you rely on it.

Distinguish the next court step from the evidence decision

Keep the court level, next date and attendance instructions exactly as stated on the latest papers. A Brampton connection does not settle where or how every appearance takes place. An early event may concern disclosure or scheduling rather than a final decision. If retained, counsel can compare the police record with your timeline, assess missing material and discuss defence or resolution options. A criminal harassment conviction can involve custody; the outcome is not automatic and needs case-specific advice. Identify any separate uttering-threats count so its different requirements are also reviewed.

Does criminal harassment always require repeated messages?

The conduct category matters. Some categories refer to repeated behaviour; others need a different assessment. Counsel must review the alleged acts and the law applying to their dates rather than assume a message count decides the charge.

Can a relative explain the allegation at my Punjabi consultation?

Discuss their involvement first. They may help with practical arrangements, but the lawyer needs your own instructions and should understand which account is personal knowledge or a translation. Tell the firm if you would prefer to speak privately.

Can a family arrangement override a criminal no-contact term?

Do not assume it does. Keep both documents available for advice and continue following current restrictions. Private permission and an informal arrangement do not lawfully change an undertaking or release order.
