Punjabi consultations and court interpretation

Dildeep Sahi provides consultations in Punjabi, English and Hindi. Tell the firm which language you prefer when arranging the appointment. Speaking Punjabi with your lawyer does not make Punjabi the language of the court proceeding or book a court interpreter.

For an Ontario Court of Justice criminal appearance, contact the courthouse before your court date to request an interpreter, or tell the judge or justice of the peace at the appearance. That court provides interpreters without charge. Confirm arrangements separately from your Punjabi consultation. Documents or evidence in another language may require a separate translation; confirm what is needed before paying for one.

Explain possession and permission as separate questions

Start with who owned or had an interest in the property, how it came into your possession and what you understood you were allowed to do. Section 322 covers fraudulent taking or conversion without colour of right and the required intent; already holding an item lawfully does not settle a later conversion allegation. A plan to return it does not automatically answer the charge because temporary deprivation can matter. Identify the exact act police question rather than treating all borrowing, shared access or employment authority as the same arrangement.

Keep the original Punjabi permission record

Explain who gave permission, what was said about use or return, and whether there were limits on passing the item to someone else. Punjabi words describing a loan, gift or temporary use should be discussed in their full context, not replaced by whichever English label seems helpful now. Preserve messages and voice notes you lawfully hold, including a later change or request for return. If permission was oral, make a separate note of your recollection and identify any witnesses for counsel. Do not ask someone to create an earlier approval or coordinate accounts of what happened.

Map movements and records to the disputed item

List when the item was received, moved, used, handed to someone else or returned. Keep relevant inventory records, serial numbers, receipts and access messages that you can lawfully obtain. Distinguish one item from another and say when a record only describes a batch or a general stock count. Counsel can use the sequence to identify questions about ownership, identification and authority. Do not access a former employer’s system without permission or attend a restricted workplace to fill a gap. A missing document should remain a gap to investigate, not a reason to invent a record.

Assess the count and any proposed return together

Keep the charge’s description and alleged value alongside any demand for return or payment. Theft carries possible imprisonment, with section 334 distinguishing the penalty categories by value and certain property types. Tell counsel about a proposed return, an item already recovered and any disagreement about what remains missing. A return does not itself end the criminal case. A workplace or contact restriction may prevent an otherwise practical handover; have the precise condition assessed and follow it unless lawfully changed.

Review disclosure without treating a summary as the whole account

Identify whether you have received disclosure and whether the records can be opened. Flag the particular permission, movement or identification you dispute and the original evidence that may explain it. Counsel can compare your instructions with the allegation, identify further material needed and discuss the options. Keep any police statement already given, civil demand and workplace correspondence separate. If your papers identify Brampton Ontario Court of Justice, use its official contacts and your current notice to confirm attendance; another person’s court arrangements do not determine yours.

  • Identify the particular item, who held an interest in it and the act police say was unauthorized.
  • Keep complete original Punjabi permission, use and return messages; note oral recollections separately.
  • Build an item-specific movement history using lawful receipts, inventory and identification records, identifying gaps.
  • Have current papers, disclosure, proposed return demands and conditions available; note each required date and Legal Aid status.

Common questions

If I intended to return the equipment, can it still be theft?

An intention to return an item does not automatically rule out theft; the law can address temporary deprivation. Explain the permission, intended use and complete sequence so the actual allegation can be assessed.

Does having workplace access mean I could take an item home?

Do not assume general access settles permission for a specific use. Identify who authorized it, the limits discussed and the original records. Counsel must assess those facts against the charge.

Should I arrange a return through a relative if there is a no-contact condition?

Do not use another person to make contact contrary to your conditions. Have the exact term and any written exception checked before arranging a handover. A family agreement does not itself change the order.

Is the Punjabi consultation also a court interpreter booking?

No. Tell counsel about interpreter needs separately and raise them with the court handling your matter. Punjabi advice about the evidence and court interpretation serve different purposes.
