Punjabi consultations and court interpretation

Dildeep Sahi provides consultations in Punjabi, English and Hindi. Tell the firm which language you prefer when arranging the appointment. Speaking Punjabi with your lawyer does not make Punjabi the language of the court proceeding or book a court interpreter.

For an Ontario Court of Justice criminal appearance, contact the courthouse before your court date to request an interpreter, or tell the judge or justice of the peace at the appearance. That court provides interpreters without charge. Confirm arrangements separately from your Punjabi consultation. Documents or evidence in another language may require a separate translation; confirm what is needed before paying for one.

Identify your part in the disputed transaction

Write down whether you requested, approved, entered or processed the payment and who else was involved. General account access, a job title and the instruction for a particular transaction are separate pieces of information. Keep the police description alongside what you personally remember, and mark anything learned afterwards. Fraud under section 380 concerns deceit, falsehood or other fraudulent means; an accusation about a payment needs assessment against the actual conduct and records. The consultation can help identify what counsel needs to investigate rather than assume an account name tells the whole story.

Explain Punjabi instructions in their original context

A payment instruction may arrive by message, call or through someone else. Explain which language was used, the exact words you remember and what you understood you were being asked to do. Preserve complete Punjabi exchanges and any approval or follow-up, rather than selecting only a sentence that supports your account. Identify who had authority to give instructions and the records supporting that understanding. Do not ask a colleague to agree to a new version of events or create an approval now for an earlier transaction. Punjabi legal advice can clarify the questions; it does not establish that an instruction was authorized.

Connect account activity to a dated record

List the disputed entries and identify the invoice, contract, approval message or transfer record for each. Distinguish records made at the time from a later explanation or correction. Note accounts or devices you could access and any limits on that access, without sending login credentials to the firm. Preserve only material you can lawfully obtain; do not enter another person’s account or bypass an access restriction to collect evidence. Missing information should be identified for counsel, who can consider appropriate steps to obtain it. A tidy spreadsheet prepared now should remain separate from the originals.

Use disclosure to focus the defence discussion

If charges have been laid, say whether disclosure has arrived and keep all versions available for an agreed review. Identify a transaction, attribution or translation that you dispute and explain the record behind the concern. Counsel can compare the allegation with the available documents, discuss further requests and advise about the prosecution position or a trial. You do not need to supply a long confidential history in the first enquiry. A court date or police request still needs attention while records are being gathered.

Discuss consequences without treating an offer as an outcome

A fraud conviction can carry imprisonment. Value is relevant to the offence’s penalty framework, but the outcome is assessed on the specific charge, evidence and circumstances. Tell counsel about any request to repay, employment concern or separate civil proceeding so the scope of advice is clear. A payment offer does not itself settle the criminal case. Keep current restrictions on account use, workplaces and contact available before considering a proposed meeting or transfer. Do not assume that a manager, complainant or family intermediary can change a release condition.

Common questions

Does being named on an account prove I committed fraud?

It does not answer every question about the allegation. Explain the access you had, what you actually did, the instructions received and the supporting records. Counsel must assess the specific conduct and evidence.

Should I create a new invoice or approval to explain an old entry?

Do not alter or replace original evidence or backdate a record. Keep a separate note explaining what you believe happened and what is missing. Discuss any genuine correction and the original versions with counsel.

Can Punjabi advice resolve a disputed translation in the disclosure?

You can explain why the meaning or context is disputed and preserve the complete original. Counsel can assess what further work is needed. A consultation does not itself create a court-ready translation or decide what evidence the court will accept.

Will my Legal Aid certificate automatically cover the financial review?

No. Legal Aid Ontario decides eligibility and authorized work. Aftermath Law accepts criminal law certificates but must check coverage, conflicts, availability and scope and agree to act before representation is confirmed.
