Identify the statement or transaction being questioned
Start with the actual police request, charge papers or disclosure. Identify the statement, promise, document or transaction said to be misleading, and say if that detail is still unknown. Keep a civil payment demand separate from the criminal allegation. Note who is said to have communicated the information, who received it and which dated record contains it. If several transactions are involved, distinguish them instead of treating an overall account balance as the whole case. Before giving a voluntary account to police, seek advice about your position and any specific obligation to respond.
Explain what information was available at the relevant time
For each disputed statement or step, identify what you personally knew and the records you relied on then. Keep earlier instructions, estimates, agreements or messages separate from information learned afterwards. If you passed on information from someone else, explain its source and what you understood it to mean, without assuming that this alone resolves the allegation. Counsel can compare the account with the evidence about the representation and your role. A later business problem or unpaid amount does not by itself provide the complete analysis of an earlier fraud allegation.
Show how the account changed as events developed
Prepare a dated outline of relevant updates, delivery or payment events, changes to instructions and communications about a problem. Mark whether each entry comes from a document, your recollection or information supplied later. Preserve original versions of contracts, invoices, statements and full message exchanges that you may lawfully access. If figures or descriptions changed, retain the earlier record as well as the later one and identify the difference for review. Do not backdate, replace or alter a document to make the history appear consistent, and do not use another person’s login to obtain missing material.
Keep explanations and proposed solutions separate
An account of what happened and a proposal to repay, return property or settle a dispute are different matters for advice. Keep the whole proposal, who made it and any stated response date. Explain anything already paid, promised or communicated. A private settlement does not itself control a criminal prosecution, and offering repayment should not be treated as a guaranteed way to end a charge. This page concerns defence of an investigated or accused person; a request to recover money through a civil claim requires separate scope clarification before the firm can agree to that work.
Identify the current restriction and next required step
Keep the latest release terms, appearance papers and later directions together. Identify any restriction that affects contact, a workplace, an account or obtaining records. Do not assume an invitation permits conduct prohibited by the actual terms. Tell counsel about the next known police or court step and whether another lawyer already represents you. Use the court level, location and event shown on the current documents; a Toronto connection does not establish the venue or attendance method. Waiting for financial records or requesting a consultation does not excuse a required appearance.

- Identify the particular statement, promise or transaction alleged, with the source and date if known.
- Separate what you knew at that time from later developments or information supplied by someone else.
- Preserve complete original versions and a dated outline showing changes, payments and relevant communications.
- Keep private proposals, current restrictions and the next required step available for agreed review.

Common questions
Does a failed transaction or missed payment prove fraud?
Not by itself. Counsel must assess the representations, what was known, the effect on money or property and the applicable legal requirements. Keep the records from the relevant time as well as later developments; an outcome alone is not the complete analysis.
What if the allegation quotes only one message from a longer exchange?
Preserve the complete exchange you lawfully hold and identify the quoted passage. Explain what came before and after without changing the original. Counsel can assess the context alongside the other evidence.
Should I replace an earlier document with a corrected version?
Preserve both versions and explain what changed, when and why. Do not alter or backdate records or create a replacement history. Arrange a review of the originals and keep your explanation in separate notes.
Does this consultation start a claim to recover money from someone else?
No. This page offers advice from a criminal lawyer. A civil recovery request is a separate task whose scope and availability must be clarified with the firm. An enquiry does not start a claim, guarantee repayment or confirm representation.
