Assault with a Weapon Lawyer in Toronto

Aftermath Law provides assault with a weapon advice to Toronto clients. If accounts describe an object differently, preserve each description and its source. Counsel needs to assess the alleged assault and object’s role together without relying on a guess about what a blurry image or brief account identifies.

List the descriptions as they appear

Keep the count, statements and available images complete. Identify who described the object and whether they claim to have seen it. Do not replace several descriptions with one chosen label or assign a legal classification from an everyday name.

Explain what each source can identify

Point to visibility, angle or other factual limits you actually know, and separate them from your own recollection. Preserve original files. Do not recreate the scene or handle an object contrary to law or terms to produce a comparison photograph.

Connect the uncertainty to the alleged conduct

Identify how the object is said to have been held, carried or used and which count concerns it. An uncertain description is a review question, not an automatic defence. Counsel needs the surrounding incident, any separate possession count and any injury allegation as well.

Understand the legal questions before choosing a response

An ordinary object can raise a weapon allegation because of its alleged use or intended use. The underlying assault and the weapon-related element need assessment together. Carrying or using an object during an assault is a different question from a separate possession count, and an injury allegation may raise another branch of the provision. Work from the actual counts and preserve the full incident record.

Preparing for the first conversation

  • List the descriptions as they appear
  • Explain what each source can identify
  • Connect the uncertainty to the alleged conduct

Keep the initial website enquiry brief. Do not upload or send sensitive documents through the form; arrange any document review directly with the firm.

You do not need every item before getting in touch. Mention any approaching court or response date.

Common questions

Should I choose one object name when the sources disagree?

Keep the different descriptions and their sources. Explain what you personally know and what is uncertain rather than presenting a guessed identification as established.

Does an unclear image automatically defeat a weapon-assault allegation?

No. Counsel must assess the actual count and all available evidence. Identify the image’s limits without assuming its uncertainty decides the case.

Can an ordinary object be relevant to a weapon-assault charge?

Yes. Its alleged use or intended use may matter. Counsel needs the actual count, object description and full circumstances; the item’s everyday name alone does not settle the allegation.

Is a weapon-possession charge the same as assault with a weapon?

No. They raise different legal questions. Keep the wording of each count and identify which conduct and evidence are said to support it.
