Understanding Uncontested Divorce

An uncontested divorce proceeds without opposition to the divorce or claims in the application. One spouse can apply and serve the other, or both can make a joint application. Agreement does not remove the court’s obligation to check the legal requirements.

The legal framework

The court must have jurisdiction and proof of a divorce ground, marriage and service where required. It must be satisfied about reasonable child-support arrangements where applicable. Confirm that parenting, support and property issues have been addressed rather than omitted by mistake.

What is—and is not—uncontested

An uncontested divorce concerns a divorce that is not opposed. It may follow a sole application that is not defended or an appropriate joint application. It does not necessarily mean the parties have settled every financial or parenting question, and a simple divorce application should not be confused with a comprehensive settlement.

Marriage records, service and the evidence for the court

The application and supporting evidence must establish the basis for divorce and meet the applicable procedural requirements. The marriage certificate, separation date, spouse’s address and any agreements or orders should be available. A foreign marriage certificate may require translation or additional material; the requirements should be checked before submission.

For a sole application, proper service and the response period must be addressed before asking the court to proceed without a response. Joint applications have their own requirements. The divorce order, effective date and certificate

A divorce order and a divorce certificate are different documents. The order grants the divorce; the certificate confirms that it has taken effect. Under the usual rule, a divorce takes effect on the thirty-first day after the judgment, subject to applicable exceptions and any appeal.

Do not set a remarriage date based only on when an application was filed or an order received. Counsel can confirm the effective date and the steps for obtaining the certificate. An uncontested divorce also does not repair an incomplete agreement or automatically carry out property transfers and other settlement obligations.

What makes a divorce uncontested?

A divorce is uncontested when no responding spouse disputes the divorce or advances unresolved claims in the proceeding. The file must still satisfy legal and procedural requirements.

How is a joint divorce different?

In a joint application both spouses apply together, so formal service between them is generally not required. It is only suitable when both agree on the relief requested.

When can someone remarry?

A divorce normally takes effect on the 31st day after judgment. An appeal can delay that date; a court can shorten the period in special circumstances under the Divorce Act. Obtain the divorce certificate to confirm the effective date before remarrying.
