Assault Causing Bodily Harm: identifying what is disputed
For assault causing bodily harm, the Crown must prove that an assault caused a hurt interfering with health or comfort beyond a merely transient or trifling injury, as well as the required fault. Ordinary assault need not cause injury. The distinction matters when reviewing whether the charge fits the evidence rather than assuming every visible mark proves bodily harm.
