Understanding Enforcement of Support and Parenting Orders

Enforcement addresses a failure to follow an existing order. Ontario’s Family Responsibility Office handles support enforcement; parenting-order problems use different family-court remedies. Enforcement does not automatically change terms that no longer work.

The legal framework

The order’s wording and evidence of non-compliance determine the available response. Parenting remedies must account for the child’s best interests. Support and parenting are separate obligations: one should not be withheld because the other was not followed.

How a lawyer can assist

Counsel reviews payment or parenting records, identifies the appropriate FRO or court process and prepares a request or response. Where the order needs revision, a separate motion to change may also be necessary.

Enforcing support through the Family Responsibility Office

Support enforcement concerns collecting amounts required by an order or enforceable support provision. The Family Responsibility Office administers enforcement within its mandate; it does not decide that support should now be a different amount. A dispute about changing the obligation may need separate legal proceedings.

Keep the operative terms, payment history and FRO correspondence together. Aftermath Law can help identify whether the problem is a missing payment, an accounting issue, registration or a request that belongs before the court. Clear dates and amounts allow the proposed remedy to address the actual default.

Missed parenting time and other parenting-order breaches

Parenting orders are not enforced through FRO. Missed exchanges, withheld information or interference with court-ordered arrangements require assessment of the order’s wording, the evidence and the child’s interests. The appropriate response depends on what was required and why it did not occur.

A dated record of events, communications and attempted compliance is more useful than general accusations. Counsel can assess clarification, an enforcement request or another court remedy. Contempt is a distinct remedy with its own requirements, not an automatic consequence of every disagreement or missed exchange.

When the order itself no longer works

Enforcement asks for compliance with existing terms. Variation asks whether those terms should change. A case may raise both questions, but evidence that a schedule is inconvenient does not by itself suspend it. Counsel can identify whether a motion to change is needed alongside an enforcement response.

Continue meeting your own obligations. Support and parenting should not be withheld in exchange for each other, and self-directed penalties can make a dispute harder to resolve. Bring the order and a focused record so advice can address both immediate compliance and any necessary longer-term change.

Your representation at Aftermath Law

A practical response to missed obligations

When an order is not being followed, the first task is to identify the obligation and document what happened. A support order enforcement lawyer and parenting order enforcement lawyer can help distinguish a payment issue from a parenting dispute and assess the appropriate response. Aftermath Law can discuss the records needed to move beyond general allegations of non-compliance.

Dildeep Sahi can review payment histories, exchange records and relevant correspondence. Support enforcement through the Family Responsibility Office and parenting remedies follow different routes; if the terms themselves need changing, that concern should also be addressed rather than expecting enforcement to rewrite the order.

What we can review together

  • The exact order, a dated compliance record and any FRO correspondence.
  • The remedy sought and whether the existing terms remain workable.

Frequently asked questions

Does FRO enforce parenting orders?

No. The Family Responsibility Office enforces support obligations. Parenting-order enforcement uses different family-court remedies.

Can support be stopped because parenting time was denied?

Support and parenting are legally distinct. A person should continue to follow the order and seek an appropriate remedy rather than withholding one obligation.

What records should I keep?

Keep the order, payment history, calendars, exchange communications and concise notes of specific missed obligations. Avoid editing or selectively preserving communications.
