Aftermath Law provides fraud defence advice to Vaughan clients. If an accountant, colleague or other adviser is part of the history, preserve the actual advice and information exchanged. Keep the question and advice together

Preserve the original request, attachments and response with their dates. Identify what information was supplied and any assumptions stated. A short later recollection of advice may omit qualifications; do not rewrite it as an unconditional approval of the transaction.

Explain what you did afterwards

Describe the representation or transaction alleged and your role in it. Separate advice received before the event from an explanation supplied later. State what you knew at the time and identify uncertainty without assuming another person’s involvement resolves your own knowledge or conduct.

Identify the precise issue requiring assessment

Point to the part of the advice or exchange you believe matters and the affected money or property. Counsel can examine its significance within the criminal allegation. This enquiry does not establish a defence, initiate a professional-negligence claim or promise civil recovery.

Understand the legal questions before choosing a response

A financial loss or failed transaction alone is not the complete analysis of a fraud allegation. Counsel needs to examine what was represented, the person’s role and knowledge, and the money or property affected. Keep earlier records and later developments distinct. This page concerns advice for an investigated or accused person; a civil recovery request is a separate scope question for the firm.

Preparing for the first conversation

  • Keep the question and advice together
  • Explain what you did afterwards
  • Identify the precise issue requiring assessment

Keep the initial website enquiry brief. Do not upload or send sensitive documents through the form; arrange any document review directly with the firm.

You do not need every item before getting in touch. Mention any approaching court or response date.

Common questions

Does saying an adviser approved the transaction automatically answer fraud?

No. Preserve the actual exchange and explain the information supplied, timing and your role. The representation, knowledge and property effect still require assessment.

What if the advice was given only after the transaction?

Identify that date clearly and keep it separate from the earlier events. Later advice should not be presented as information you had when acting.

Does an unpaid amount by itself prove fraud?

No. The representations, knowledge, role and effect on money or property need assessment under the applicable requirements. Keep records from the relevant time rather than relying only on the eventual outcome.

Does a defence enquiry start a claim to recover money?

No. A civil recovery request is a separate task whose scope and availability must be clarified. This enquiry does not start a claim, guarantee recovery or confirm representation.
