Identify what the proposal says about the charge
Keep the written proposal or accurately record who described it and when. Mark whether the treatment of the existing charge is explicit or still uncertain. Do not assume that agreeing to any peace bond automatically withdraws another proceeding. Counsel needs the actual proposal and current court papers together.
Read every proposed condition against daily life
Identify the people, places, contact and other conduct covered. Explain work, home or child-related conflicts and provide existing criminal or family orders. A peace bond is not the same as a conviction, but the terms create enforceable obligations. Private agreement or invitation is not permission to ignore them.
Prepare questions before accepting or contesting
Ask what statutory provision is proposed, what material supports it and what remains to be decided at the next event. Different peace-bond provisions have different requirements. Keep current directions in force while discussing the proposal. Breach can lead to a criminal prosecution; do not treat unclear wording as consequence-free.
Preparing for the first conversation
- Current charge papers and next attendance directions.
- Exact proposal, or its source and unresolved points.
- Proposed conditions and practical conflicts.
- Overlapping criminal or family orders.
Keep the initial website enquiry brief. Do not upload or send sensitive documents through the form; arrange any document review directly with the firm.
You do not need every item before getting in touch. Mention any approaching court or response date.
Common questions
Does signing any peace bond withdraw the charge?
No. The proposal’s treatment of the charge must be checked separately. Do not assume automatic withdrawal.
Is a peace bond the same as a conviction?
No, but it creates enforceable obligations. Its conditions and any related case consequences need review.
Can the parties privately waive a condition later?
A private agreement does not itself authorize non-compliance. Seek advice about the appropriate process if circumstances change.
