Keep the funding decision in its actual wording
Bring existing LAO correspondence and distinguish a refusal from an incomplete application, request for information or uncertainty about coverage. Do not rely on a general statement that Legal Aid is unavailable. Eligibility, issue coverage and authorized work are separate questions; the specific correspondence helps identify what remains to be clarified.
Describe the immediate criminal task
Identify the next date and whether you need advice about police contact, release terms, disclosure or an appearance. State whether another lawyer is involved. A defined task allows a focused discussion of representation rather than an assumption that the entire file can be reviewed during an initial call. Keep current attendance directions in view.
Ask clear questions about any proposed retainer
If considering private representation, confirm what work is proposed, the fee arrangements and who will handle the next event. Do not infer a fixed price or free legal work from the initial consultation offer. If certificate funding later becomes available, its scope and the firm’s acceptance still require confirmation; no transfer of funding or representation is automatic.
Preparing for the first conversation
- LAO correspondence and current application or decision status.
- Actual charge papers and the next event.
- The specific advice or court work you need now.
- Any current lawyer and questions about proposed scope and fees.
Keep the initial website enquiry brief. Do not upload or send sensitive documents through the form; arrange any document review directly with the firm.
You do not need every item before getting in touch. Mention any approaching court or response date.
Common questions
Does a free initial consultation cover my appearance?
No. It discusses the situation, options and potential representation. Court work and any fee or funding arrangement must be agreed separately.
Should I describe a request for more information as a refusal?
No. Keep the actual LAO message available and identify its status accurately.
Can I assume later certificate funding will cover accepted private work?
Do not assume that. Authorized work, funding and retainer arrangements require specific confirmation.
