Keep the actual request or proposal available

Identify the police or court document and any proposed decision with its date and source. Distinguish it from a parent’s or other helper’s explanation. Give the relevant ages and case history without assuming the current age answers the youth-law questions.

Describe earlier explanations and instructions separately

Explain who discussed the matter, what was understood and whether any step actually occurred. Keep lawful existing records unchanged. Do not treat an adult’s preferred answer as the young person’s own account, or assume an informal conversation establishes an agreed legal response.

Let the young person identify remaining uncertainty

Understand the legal questions before choosing a response

The young person’s age at the alleged offence, current age and age during any questioning are distinct facts for advice. A supporting adult does not replace the young person’s own legal advice. Youth Criminal Justice Act matters are omitted from the Ontario Court of Justice’s online Daily Court Lists, and an absent listing does not cancel a required appearance.

Common questions

Does an adult’s agreement mean the young person understood the proposal?

Do not assume that. Identify what was discussed and let the young person explain their own understanding and questions. Counsel needs to assess the actual decision and advice arrangements.

What if nobody is sure whether an earlier step was completed?

Identify the uncertainty and available papers or communications. Do not describe an intended step as completed; clarify the actual position while following current obligations.

Does current age alone decide which youth rules apply?

No. Give counsel the age at the alleged offence, current age and relevant case history. If questioning occurred, the age at that time is a separate fact to identify.

Can I treat a missing online listing as a cancelled youth appearance?

No. YCJA matters are omitted from the OCJ online Daily Court Lists. Follow the current papers and clarify uncertainty with the young person’s lawyer or the appropriate court office.
