Identify the transactions actually in issue
List the dated payments referred to in the allegation and their available references. Separate a transaction you recognize from one you cannot identify. Keep original statements and messages; do not relabel transfers or change accounting entries to make a later explanation look contemporaneous.
Explain the role and authority behind each payment
Describe who requested, approved or sent the payment and what you personally understood then. Point to the relevant instruction or representation. An account bearing your name or a business title is information for assessment, not a substitute for examining the conduct and knowledge alleged.
Keep later accounting separate
Identify later corrections, reconciliations or explanations with their actual dates. A current spreadsheet can assist preparation if clearly described as newly prepared, but it should point back to the originals. Criminal lawyer services are the requested scope; tax advice or civil recovery should not be assumed to be included.
Understand the legal questions before choosing a response
A financial loss or failed transaction alone is not the complete analysis of a fraud allegation. Common questions
Can I use a newly prepared transaction list?
Yes, as a clearly identified preparation aid linked to original records. Do not present it as a document created at the transaction date or silently replace earlier entries.
Should personal transfers be omitted from a business-fraud summary?
Identify any transfer relevant to the allegation and explain its purpose and source. Counsel needs the actual transaction history, including uncertainty, rather than a category chosen to favour one account.
Does an unpaid amount by itself prove fraud?
No. The representations, knowledge, role and effect on money or property need assessment under the applicable requirements. Keep records from the relevant time rather than relying only on the eventual outcome.
Does a defence enquiry start a claim to recover money?
No. A civil recovery request is a separate task whose scope and availability must be clarified. This enquiry does not start a claim, guarantee recovery or confirm representation.
