Impaired Driving Lawyer in Newmarket

Aftermath Law provides impaired-driving and refusal advice to Newmarket clients who need to understand a proposed next step in their case. Start with the charge and the response being requested

Have the exact wording of each count and the request or proposal that needs attention. DUI is a common term, while impaired operation, a prohibited alcohol or drug concentration and refusal raise different legal questions. Explain who has asked for a response, any stated date and whether another lawyer already acts for you. If no resolution has been proposed, identify the next case event and the question you want answered. Counsel can then assess the work needed without assuming that a general description of the incident identifies the whole case.

Keep the complete proposal and explain your understanding

Preserve the written proposal, covering message and any later version. Identify which charges, proposed steps or consequences you understand it to address, and mark anything unclear. If it was discussed verbally, make a separate note of who spoke, when and what you remember rather than presenting the note as agreed wording. Tell counsel about anything you have already said, signed or done in response. An expected result should be discussed alongside the actual proposal and case record; do not treat a summary as a guarantee of what will happen.

Identify the evidence questions behind the proposed response

For each concern, point to the police passage, recording, testing document or other record you want reviewed. Discuss your recollection and estimates privately with defence counsel, and ask how any explanatory notes should be prepared. Impairment, concentration and refusal allegations do not all turn on the same evidence. For a refusal allegation, explain the demand as you understood it, your response and any difficulty during an attempt. Identify material referred to but not received, or a file you cannot open. Counsel can assess what further review is needed before advising about the proposal, a plea or trial; a disagreement or missing item does not itself decide the case.

Ask separately what the proposal means for driving

Keep current licence-suspension, impoundment and towing notices available even if the proposal discusses the criminal charge. Identify the issuing body, date and instructions on each notice, and explain the practical question needing advice. Criminal proceedings and administrative measures have separate processes. A proposed criminal resolution, a pending court date or a need to drive for work does not establish permission to drive. Any available administrative review depends on the particular measure and its process. Ask what assistance the firm can consider; criminal representation does not automatically start that separate work or change a restriction.

Continue to follow the current court and release directions

Keep the latest court directions, charge papers and release terms together. Identify the actual event, date, court level and attendance method, rather than using a proposal’s response date as the date for every obligation. A Newmarket address does not determine where or how the matter is heard. Current terms continue to apply unless lawfully changed, and arranging advice does not excuse a required appearance. Tell the firm about an approaching event when requesting the consultation and confirm any agreed court attendance expressly.

Arrange a Newmarket impaired-driving consultation

Aftermath Law serves Newmarket from 250 Dundas Street West, Suite 402, Mississauga, ON L5B 1J2. Office visits are by appointment only. Consultations with Dildeep Sahi are available in English, Punjabi and Hindi. The free initial consultation discusses your situation, options and potential representation. Keep the enquiry brief, noting the charge, next known date and proposal or question needing advice. Arrange delivery of detailed or sensitive records directly. A full evidence review, legal opinion on a proposed response, negotiations, court attendance and any available administrative work must be expressly agreed after the firm considers the matter, conflicts and availability.

Preparing for the first conversation

  • Keep each exact count, the full proposal and any later version or stated response date.
  • Explain your understanding and anything already said, signed or done in response.
  • Identify the evidence behind each question, preserving originals and marking missing material or uncertain recollection.
  • Have separate driving notices and the latest court and release directions available for agreed review.

Keep the initial website enquiry brief. Do not upload or send sensitive documents through the form; arrange any document review directly with the firm.

You do not need every item before getting in touch. Mention any approaching court or response date.

Common questions

What should an impaired-driving lawyer review before I respond to a resolution proposal?

The actual counts, the complete proposal, the available evidence and your questions about the proposed steps or consequences. Keep earlier versions and explain anything already done. The necessary review depends on the case; an initial consultation is not a complete opinion on the proposal.

Does a proposal about the criminal charge also settle my licence suspension?

Do not assume so. Criminal proceedings and administrative measures have separate processes. Have the actual licence or vehicle notice available so the particular issue and any available review can be assessed. A proposal does not establish permission to drive or automatically start separate administrative work.

Does having no test result mean a refusal allegation can be ignored?

No. Refusal is a distinct allegation concerning the response to an authorized demand. The demand, its communication, what was attempted and the available evidence need review. The absence of a completed result does not itself answer the allegation or excuse current obligations.

Will my Newmarket DUI case necessarily be heard in Newmarket?

Do not assume that from the city connection alone. Use the court level, location and event identified in your current papers and later directions. Confirm uncertainty with your lawyer or the appropriate court office, and follow the actual attendance instructions.

Is a full review of the proposal and evidence included in the free consultation?

No. The free initial discussion concerns the situation, options and possible representation. Detailed evidence review, advice on a proposed response and further court or administrative work need an expressly agreed scope. Contacting the firm does not confirm representation, change a restriction or extend a deadline.
