Identify what information is alleged to be missing
Keep the complete request, form or correspondence and the allegation that refers to it. Mark the information said to be missing, who asked for it and the relevant stage or stated date. An incomplete document does not by itself establish fraud; do not assume a disclosure duty from the allegation alone.
Describe what you knew and supplied at the time
Identify your role in preparing, reviewing or sending the material and what information was then available to you. Preserve instructions, qualifications and surrounding communications. Separate a fact you knew at the time from something learned later, and mark uncertainty rather than fill a gap from memory.
Keep later corrections distinct from the original event
Preserve any later explanation or corrected version with its date and source. Make a separate chronology showing what changed without replacing the original. A correction does not by itself decide the criminal allegation. Counsel needs the alleged omission, contemporaneous context and money or property effect together; a defence enquiry does not start a civil recovery claim.
Understand the legal questions before choosing a response
A financial loss or failed transaction alone is not the complete analysis of a fraud allegation. Counsel needs to examine what was represented, the person’s role and knowledge, and the money or property affected. Keep earlier records and later developments distinct. Common questions
Does a blank field by itself prove fraud?
No. Identify the actual request, allegation and surrounding records. Counsel must assess the applicable requirements, your role and knowledge, and the money or property affected rather than treat incompleteness as the whole test.
Should I replace the original form with a corrected copy?
Keep both unchanged, with their dates and source. Explain what information was supplied later without presenting the correction as what was sent originally or assuming it decides the allegation.
Does an unpaid amount by itself prove fraud?
No. The representations, knowledge, role and effect on money or property need assessment under the applicable requirements. Keep records from the relevant time rather than relying only on the eventual outcome.
Does a defence enquiry start a claim to recover money?
No. A civil recovery request is a separate task whose scope and availability must be clarified. This enquiry does not start a claim, guarantee recovery or confirm representation.
