Describe the alleged interruption

Explain the activity, access or use said to have been affected and its timing. Separate your own observations from an estimate supplied later. Counsel needs the actual allegation; a photograph showing no damage may not address a claimed interruption, while a photograph of damage may not show who caused it.

Keep condition and use records separate

Preserve available before-and-after photographs, maintenance records and messages about access. Note the date and source of each. If the property already had a problem, identify the supporting record without altering it. A repair estimate records a proposed cost, not necessarily the whole history of condition or use.

Explain ownership and any practical proposal

Identify the ownership or access arrangement and keep any agreement available, including where property was shared. Describe a proposed repair separately from what has actually occurred. Joint ownership or a repair offer does not automatically settle a mischief allegation; criminal advice and any separate civil work require their own assessment.

Understand the legal questions before choosing a response

Mischief allegations can concern damage or interference with property use. The actual count, conduct, property and permission need assessment; a photograph of damage may not describe every issue. Joint ownership does not automatically answer the allegation. Preserve the condition and use records, and keep any repair or payment proposal separate from current restrictions and the criminal response.

Preparing for the first conversation

  • Describe the alleged interruption
  • Keep condition and use records separate
  • Explain ownership and any practical proposal

Keep the initial website enquiry brief. Do not upload or send sensitive documents through the form; arrange any document review directly with the firm.

You do not need every item before getting in touch. Mention any approaching court or response date.

Common questions

Is a photograph with no visible damage enough to answer the charge?

No. The actual alleged damage or interference needs review. Explain what the image shows and its date, together with the claimed effect on use or access.

Should I combine a repair offer with my account of the incident?

Keep them distinct. Preserve the original account and identify the later proposal as a proposal, so counsel can assess the allegation without confusing it with a settlement request.

Must there be broken property for a mischief allegation?

No. An allegation may concern interference with use as well as damage. Have the exact count and the account of what happened available for legal assessment.

Does owning the property mean the allegation can be ignored?

No. Ownership, any other interests, permission and the alleged conduct need review. Do not assume shared ownership or a repair offer answers the criminal issue.
